Our Contract With You

Our contract with you is formed under the rules and guidelines set out in the United Kingdom's Consumer Contracts Regulations 2013.

By submitting an order with us, you (the customer) are making an offer, even if payment is made at the time of this offer.

Your offer is deemed to have been accepted by us only at the point that we dispatch the goods.

If we are unable to accept your offer, we will inform you of this either by phone or by email. If payment has already been made, it will be refunded. Our inability to accept your offer might be because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product, or because we are unable to meet a delivery deadline you have specified.

Delivery Policy

Our website intelligently works out the available options for delivery of your goods. There will normally be several options for you to choose from covering a range of prices and delivery speeds. The prices displayed for delivery are shown excluding VAT, where applicable. We use Royal Mail's various services, as well as Courier services. Charges for super fast UPS deliveries into Europe have recently been lowered.

Delivery Schedule

We usually ship all orders the same day (Monday to Friday), subject to the order being received by us before 4pm. International orders may take longer.

Stock errors

Our website provides live stock indicators, and will prevent you from ordering products that are not in stock. Owing to us having a busy "bricks and mortar" shop as well as a busy website, on very rare occasions it might be possible for the system to allow you to purchase an item that has sold out in the shop, but has not yet updated the website. This is down to technology limitations and is currently unavoidable. If you encounter this scenario, we aim to resolve the issue immediately. Please make sure we have up to date contact details for you in your account.

Credit Card Security

We use Braintree and PayPal to deliver our payment gateways securely. We do not store any credit card details online. We know of no documented cases of credit card fraud using our shopping system over the Internet.

Cancellation, Returns and Refunds

Right of Cancellation

The United Kingdom's Consumer Contracts Regulations 2013 provide you with a right to cancel your order for products at any time up to 14 days following the day after the day on which you received the products. You do not need to give us any reason for cancellation. If you wish to cancel your order please either write to us at the address in the footer of every page on this website, or email us with details of your cancellation. If you have already received the products you must carefully repackage and return them to us at the returns address shown below. Until you have returned the products to us, you must keep them in your possession and take reasonable care of them. We will credit the price of the cancelled products once we have received and checked that they are in a re-saleable condition. We will not refund any postage costs incurred.

Damaged Goods

We will take great care to ensure that you receive your goods in perfect condition. However, if your goods are damaged or faulty, please call us on 01455 637762 within 3 working days of receipt of your order. We will either replace the goods or arrange a refund as appropriate. We will also pay you the cost of the return postage. You will need to include a covering letter in the package stating the reason for return, and you might need to obtain a proof of posting certificate from your Post Office for us to be able to refund your postage costs.

Returns Address

Please mark return parcels for the attention of the Returns Department at the usual address (in the footer of the website).

For all goods returned, we recommend that you use a secure delivery method which requires a signature upon delivery such as Royal Mail First Class (Recorded Delivery) as you will be responsible for the goods until they are received by us.

Who pays the fees for international deliveries?

When a package is delivered internationally (outside the UK), it may be subject to import taxes, customs duties, and/or other fees (such as handling fees) imposed by the destination country. These charges are typically due once the package arrives in the destination country.

It is the responsibility of the buyer to check what their local additional fees might be, before purchasing their goods from us, and for paying any of those required fees that may arise from a purchase from us when they become due (usually at the point of importation into the destination country).

These charges can vary widely and are often based on the price and type of item, and the taxes, duties, and fees of the destination country.

It is not possible for Midland Helicopters to predict which of these fees, if any, will be applied to your purchase when it arrives in your country, and therefore we do not calculate or collect these fees or taxes on your behalf.

Midland Helicopters isn’t responsible for any additional charges that may apply after a purchase is completed, and we are also not responsible for the cost of returning an item to us if the buyer doesn't pay the required fees.

WEEE Regulations

The Waste Electrical and Electronic Equipment (WEEE) Directive is now UK law. The legislation aims to make producers pay for the collection, treatment and recovery of waste electrical equipment.

The regulations also mean that suppliers of equipment like high street shops and internet retailers must allow consumers to return their waste equipment free of charge.

The amount of WEEE we throw away is increasing by around 5% each year, making it the fastest growing waste stream in the UK. Much of the UK’s WEEE ends up in landfill, where the lead and other toxins it contains can cause soil and water contamination. This can have a harmful effect on natural habitat, wildlife and also human health.

Many electrical items that we throw away can be repaired or recycled. Recycling items helps to save our natural finite resources and also reduces the environmental and health risks associated with sending electrical goods to landfill.

Distributors of new Electric and Electronic Equipment (EEE) have a part to play in reducing the amount of WEEE going into landfill sites. We are obliged under these regulations to offer our customers free take-back of their WEEE on a like-for-like basis when you buy a new Electrical or Electronic product from us.

For example, if a customer bought a new appliance from us we would accept their old appliance back and prevent it going into a landfill site by disposing of it safely. The recycling/disposal service is offered free of charge. Customers must return their WEEE item to us within 28 days of purchasing their new item. Alternatively we offer a collection service charged at £19.98 (inc VAT) - this service must be requested at the time of ordering your new appliance. Any appliances that we are collecting should be disconnected and ready for collection at the time the new appliance is delivered.

Under the WEEE Regulations, all new electrical goods should now be marked with the crossed-out wheeled bin symbol shown below:

To remind you that old electrical equipment can be recycled, it is now marked with a crossed-out wheeled bin symbol. Please do not throw any electrical equipment (including those marked with the crossed out wheeled bin symbol) in your bin.

Under the Waste Battery Regulations, Midland Helicopters Ltd are now offering a take back scheme for all portable waste batteries. You can return your waste batteries to our business premises in person (please do not post). Alternatively, you can find your local waste portable battery recycling facility at Most supermarkets and shops that sell batteries will have collection bins for used batteries, and some town halls, libraries or schools may also set up collection points. End-users may find stores in their local area more accessible.
